The rule of administrative law is that administrative decisions are considered effective from the moment they are published, and their execution does not affect the mere recourse of these to justice because of the unfailing effect of the call.

However, the slowness of legal proceedings and the investigative nature of administrative litigation procedures, adjudication of the case may take some time and lead to the emergence of harmful consequences for the complainant as a result of the execution of the appealed decision.

The case may reach the point of the impossibility of enforcing the annulment decision.

In order to avoid this, the law on civil and administrative procedures allowed the complainant to request a stay of execution of this decision until the court annulment case was decided.
