The law is a living being that responds to social changes, according to a complex procedural path, but some developments require immediate and rapid intervention, and from here the technique of legislation by ordinance emerged, as a tool that embodies cooperation between the legislative authority and the executive authority, and thus the flexible separation of powers to achieve the public interest.

However, the frequent resort to these ordinances has caused negative effects, including compromising legal security through legal inflation, and violating legitimate expectations.

Therefore, this scientific paper came to discuss the impact between ordinance and legal security in Algeria and France.
