Publicity is a commercial technique as well as an artistic creation.

Eventhough the publicity contract is subject to autonomy and the free will of business transactions, the substance of the contract is subject to some legal controls concerning the production of publicity and it's distribution, and these controls range from regulation to prohibition depending on the service they want to protect, which relates mainly to public order, public decency, the protection against unfair competition, protecting children and women and the consumer as well as protecting the environment, cultural heritage and road safety.

For this end, the legislator has put control mechanisms to guarantee the respect of these legal boundries, it has also put sanctions, administrative or penal, according to the case in hand.
