Le nouveau rôle confié à la cour constitutionnelle Algérienne pour la réalisation du concept de sécurité juridique

Article 195 of the Constitutional Revision 2020, which was introduced to the Algerian constitutional regime in 2016, has drawn our attention, by allowing individuals the possibility of proclaiming the unconstitutionality of the norms that manage their conflicts.

Article 198/4 explicitly declared the effect of the decision containing the unconstitutionality of the text, or it loses its effect from the day provided for by the decision of the constitutional court.

This situation prompts us to question the content of the court's decision.

This article give the Constitutional Court a new task, it is the creation of a balance between its role to rule constitutional legal provisions on the one hand, and the right of individuals to enjoy sufficient stability of their legal status and their acquired rights; the principle of legal certainty on the other hand.

L'article 195 de la révision Constitutionnelle2020, qui a été introduit au régime constitutionnel algérien depuis 2016 a attiré notre attention, par sa permission aux individus la possibilité de proclamer l'inconstitutionnalité des normes qui gèrent leurs conflits.

L'article 198 /4 a déclaré explicitement l'effet de la décision contenant l'inconstitutionnalité du texte, ou il perd son effet à partir du jour prévu par la décision de la cour constitutionnelle.

Cette situation nous pousse à s'interpeler sur le contenu de la décision de la cour.

Cet article met la cour constitutionnelle devant une nouvelle tache c'est la création d'un équilibre entre son pouvoir de statuer des dispositions légales constitutionnelles d'une part et le droit des individus à jouir d'une stabilité suffisante de leurs statuts juridique et leurs droits acquis; le principe de sécurité juridique d'une part Autre.
