The issue of nationality as a universal human right receives great attention at the internal and international levels, this becomes more important if it comes to the right of the child on a nationality, as he is the most likely to be deprived of it.

This was embodied in the relevant international conventions seeking to lay down the general foundations for enabling the child to obtain a nationality, as in domestic legislation as well, to make a legal framework to provide a minimum protection of this right.

Algeria has accompanied this path by ratifying relevant international conventions, and also by amending Ordinance No.

70-86 containing the Algerian Nationality Law by the Order 05-01 as An attempt to protect the right of children to be born with a nationality even if their parents are deprived of it; which is known as nationality by birth and organized under the principle of original nationality, and then the protection of their nationality by regulating the collective effect of nationality, whether in the case of acquisition of nationality or in the event of its loss.

However, the realization of these efforts on the ground revealed many shortcomings and contradictions.
