The International Criminal Court seeks to uphold the principle of non-impunity in order to confront violators of the rules of international humanitarian law of a legal nature, To the extent that rules of international humanitarian law are regarded as jus cogens and binding and cannot be violated and as obligations erga omnes, However, the Statute of the International Criminal Court has many contradictions and legal gaps that would limit the Court's effectiveness in providing international criminal protection for the rules of international humanitarian law against violations , accordingly, the problem of the study revolves around the following question: To what extent can the Rome Statute be considered a guarantor for strengthening the international criminal protection of human rights during armed conflicts?.
