Abstract EN

This research presents an original study on the theme of: the appropriation by the woman of her money and the permissibility of her financial actions, from the point of view of the Dhaheri method.

The problem of the study - which is aimed at this research - is: how has the jurist Dhaheri treated the legal texts - which affirm in their context - the preference of men over women? Did Ibn Hazm adhere to the letter of the text, and therefore, he approved of her lack of mental capacities and personal potentials, and therefore she has no right to own money or apply provisions, or did his Dhaheri approach help him with rules that preserved the legal status and divine honor of women in all of their conditions? To answer this problem, I followed the inductive and analytical approach, and the study was divided into an introduction, two headings and a conclusion.

Among the most important conclusions of the research: Ibn Hazm demonstrated the flexibility of the Dhaheri approach in the subject of the woman's stewardship of her money property, thus the financial responsibility for her independence of the men, and the permissibility of her financial actions.
