تقوم مسئولية الناشر الإلكتروني المدنية عن اعتداءه على أحد حقوق الملكية الفكرية للمؤلف، و ذلك إذا قام بنشر و إتاحة أحد المصنفات المشمولة بالحماية القانونية المقررة في قوانين الملكية الفكرية عن طريق استخدام برامج نبادل و مشاركة المصنفات بتقنية p2p.
إن تبادل الملفات و مشاركتها بتقنية p2p لا يتحقق به استثناء النسخة الخاصة أو الاستخدام العادل أو الحر والذي يعد قيد على حق المؤلف الاستئثاري في استغلال مصنفه.
ذلك أن نسخ المصنف بتقنية p2p لا يتحقق به شرط الاستعمال الخاص الذي يعد الشرط الجوهري في تطبيق تلك الاستثناءات، بل على العكس فإن نسخ المصنف بتلك التقنية يجعل المصنف محلاً للاستعمال الجماعي، ذلك بالإضافة إلى عدم وجود تصريح أو أذن من المؤلف أو من أصحاب الحقوق على المصنف.
و بناء على ذلك فإن نسخ المصنف بتلك الطريق يندرج تحت النسخ غير المشروع الموجب للمسئولية.
Abstract EN
The development of communication and information technology has contributed to the development and creation of new means of communication, exchange and sharing of works with each other.
Among these technologies are electronic programs aimed at uploading and exchanging files and information, which is called peer-to-peer or peer-to-peer programs.
With the spread of p2p programs and their unprecedented development in all parts of the world, they pose a threat to intellectual property rights, and with the spread of exchange of works through these programs, the question arose about the extent of the responsibility of the electronic publisher for the illegal use of works through p2p programs
