The evolution of information field and the intervention of the machine as an important element in various fields of life, does not only lead to the development of new forms and contents of criminal behavior.

This evolution has led to the emergence of a new pattern of evidence known as digital evidence.

The privacy of these evidences raise a clearly defined problematic issue in the field of criminal evidence.

This problematic issue is based primarily on some restrictions set regarding the acceptance and use of the evidence.

Therefore, the evidentiary value of the digital evidence in the field of criminal evidence depends on its compatibility with the general conditions developed by this system regarding evidences in general.

In this context, the aim of this research is mainly to answer a specific question about the idea of accepting the digital evidence in the field of criminal evidence
