Abstract EN

In the light of the Algerian constitutional amendment 2020, this article come to study the submission of ordinances of the President in urgent matters in the ence of Parliament, as well as the decisions of the event of state of emergency, to the control of the Constitutional Court, because these mechanisms escape control in the constitution of 1996, with its various amendments, until 2016, given the issue has not been resolved clearly.

This has led us to a study of the provisions governing this jurisdiction, and we have found an ambiguity, which makes interpretation difficult, which requires more clarification in order to qualify the Constitutional Court to play a central role to regulate the functioning of constitutional institutions.
