Beverage Shops are among the commercial activities that are subject to the obtainment of a prior administrative license after certain conditions are met.

More so, the person carrying out this activity must comply with the legal and regulatory texts regulating it and not, through his practices, affect the public order and its requirements (public security, public health and tranquility).

Otherwise, he will be subject to the penalty of temporary closure or final closure in accordance with legal controls included in Ordinance No.

75 - 41 related to the exploitation of beverage shops.

These legal controls are considered as both restrictions on the administrative authority issuing the decision of the closure.

At the same time, they are legal guarantees granted by the legislator to the owner of the shop, who obtained a prior administrative license, vis-à-vis the administration from arbitrariness and pretension by applying the legal texts and maintaining public order.

It also, allows the owner of the shop to clarify the limits of the administrative authority and present its decisions to the legitimacy control before the competent administrative judicial authorities.
