Taking into account the seriousness of the financial and economic consequences of the infringements of violation of the legislation relating to the exchanges and the movements of capital, the legislator distinguished them by a particular regulation and strict penal sanctions, and in spite of the importance of the punitive measures imposed, it is difficult to erase the pecuniary damages resulting from the commission of such crimes due to the difficulty of locating and recovering the funds transferred abroad in foreign currency; recover funds transferred abroad in foreign currencythe Algerian legislator has become aware of the need to take preventive measures aimed at monitoring the movement of capital before the transfer process and ensuring its legitimacy.

Banks play a major role in taking such measures through bank domiciliation procedures, in addition to procedures imposed on transfers of capital resulting from foreign investments.
