Article 73 of the Algerian Labor Relations Act is of great concern to workers because it identifies the serious mistakes that result in layoffs, and therefore means the death penalty in economic life; For this purpose, the view of Algerian labor legislation differed when enacting this text through legal mechanisms and legislative purposes.

Political, economic and social factors contributed to this, which made the jurisprudence conflicting.

Although the position of the Algerian legislator was initially in line with the economic transformations, the one finally settled on it remains far from leaving the issue of identifying the serious errors of the principle of the authority of the will, which is required by the liberal system and under the supervision of the judiciary to prevent any abuse in the use of the power of dismissal.
