The crime of kidnapping is one of the most serious forms of crime and social deviation that affects the most fundamental human rights, such as the right to life and freedom.

The weakest human beings on earth, especially minor children, male and female, who have not yet completed their eighteen years of age are subjected to this crime, in particular, as they are a tool that is easy to possess and tamper with.

The seriousness of this crime increases if it is associated with other crimes such as organ trafficking, sexual exploitation, employment in terrorist crimes and others.

In view of the escalation of cases of minors kidnapping, the Algerian legislator reconsidered the provisions of the Penal Code and was interested in finding legal mechanisms that embody his penal policy in fighting against the crime of kidnapping.

He created special provisions that criminalize all acts of kidnapping, whatever their nature, and punish any person who tempted himself to kidnap a minor or deport him without violence, threat or deception.
