تؤدي الأحزاب السياسية أدورا متعددة في العديد من المجالات السياسية و الاقتصادية و الاجتماعية، فهي دعامة أساسية للبناء الديمقراطي، وسوف نتطرق في هذه الدراسة إلى حرية إنشاء الأحزاب السياسية في الجزائر بناء على القانون العضوي رقم (12- 04) المتعلق بالأحزاب السياسية، وذلك بالتركيز على إبراز الشروط القانونية المطلوبة و الإجراءات الواجب التقيد بها لإنشائها، إلى جانب عرض واقع الأحزاب في الجزائر و تأثيره على الحريات السياسية، وتوصلنا إلى نتيجة هامة وهي أن الممارسة الميدانية بينت أن هذا القانون يعتريه العديد من النقائص مما انعكس سلبا على هذه الحرية
Abstract EN
Political parties play multiple roles in many political, economic and social fields, It is an essential pillar of democratic building, In this study, we will discuss the freedom to establish political parties in Algeria based on Organic Law No (12-04) relating to political parties, By focusing on highlighting the required legal conditions and the procedures that must be adhered to for its establishment, In addition to presenting the reality of parties in Algeria and its impact on political freedoms, And we reached an important conclusion, which is that field practice showed that this law suffers from many shortcomings, which negatively affected this freedom.
