the evolution of the international law has resulted in an emergence of new branches beside the classical ones- which is basically represented in its applications in the armed conflicts as a first stage overriding all international relations- and overlaping between its branches especially the international humanitarian law and the human rights laws, this latter that appeared as a second stage in the international relation because of what the first stage has left of devastation and destruction behind the nations.

Despite Their Difference in Application and naturethey are, to a great extent, similar in many points which will be the theme of our study.
