Abstract EN

The paper deals with the criminal and moral obligation of heads of state towards violating human rights, and aims to know the concept of criminal responsibility and the foundations on which it is based, and developments in international criminal law to determine the criminal responsibility of heads of state.

The problem of the paper is: What is the nature of the criminal responsibility of heads of state towards violating human rights? What is the concept of criminal responsibility and its foundations? What is the concept of human rights violation? What human rights can heads of state violate? To address the questions raised by the paper, the paper follows the legal approach and the descriptive-analytical approach.

The paper reached several results, the most important of which are: Among the most important recommendations: Amending Article (28) of the Rome Statute, which established the responsibility of leaders and chiefs by including a text stating that the International Criminal Court is the competent authority to determine that the procedures were necessary and reasonable.
