in this study, we will illustrate the state's responsibility for the Judiciary works as one of the most important aspects of legal state's dedication and the achievement of the judicial security, which has had a constitutional enshrinement among many facets and scattered legal texts, and represented in the right of an injured party to get a compensation for unjustified detention on remand and the compensation for a miscarriage of justice in line with the code of Penal Procedure, And in the context of searching for the guarantees which gives the injured party from the judicial work, the right of compensation.
