Recent years witnessed an unprecedented uprising of people against authoritarian regimes, during which masses demonstrated in many countries around the world to defend their basic rights.

These events generally fall under the category of internal disturbances or tensions that states usually confront by arresting large numbers.

This study examines how international law addresses situations of internal disturbance.

And it raises mainly the issue of the immunity of some basic rights (especially the rights of persons deprived of their liberty(.

Therefore, we will analyze the non-derogable character of certain rights: the prohibition of arbitrary detention, a fair trial and humane treatment, and then it will assess the effectiveness of this immunity, by examining international human rights enforcement mechanisms role in protecting non- derogable rights in order to discover deficiencies and research about possible alternatives.
