Abstract EN

Praise be to Allah, Lord of the worlds, and may blessings and peace be upon the one who was sent as a mercy to the worlds, our master Muhammad and his family and companions.

Afterwards: Hajj is the intention to Kaaba to perform a specific worship in a specific time with specific conditions, which is the fifth pillar of Islam, and it represents an obligation on every adult Muslim who has strength, easiness and health.

Hajj is obligatory according to Quran and Muslims, also the purified Sunnah of the prophet.

The prophet was asked: which work is better? He said: '' Belief in Allah and his Messenger''….

He was asked, then what? He said: '' An accepted Hajj'', and he said '' whoever performs Hajj and does not spoil and does not commit sexual immorality, he will return like the day his mother gave birth to him''.

Hajj is obligatory for one who fulfills the following six conditions: Islam, reason, puberty, freedom, safety of the road, and ability.

Imam Al-Sharabi, may Allah have mercy on him, set forth in his book these issues which he described as negligible, which means '' a few'', with regard to lessor and wage earner in Hajj and Umrah, he took and compiled them in these papers from various books of respected scholars, he (AL-Sharabi) did it for beginners as he said in his introduction.

These issues contained the achievement of Hajj for others, except death or helplessness, while the latter means un ability of performing Hajj (according to dictionary), and (according to language) means paralysis, dementia, and lameness.

If someone is an adult and sick must send a person to perform Hajj on his/her behalf with wage at once, while if they are under the age of puberty can send someone to do Hajj at anytime if there is a distance, but if there is not they can do Hajj by themselves.

Imam Al-Sharabi also mentioned leasing, its divisions, and conditions: He says: the leasing is done in two ways: 1- Hiring a liability: he says that you are obligated to get Hajj for me or my dead with this amount.

2- Same lease: To say I hired you to do Hajj for me or my dead with this amount.

Imam Al-Sharabi relied on the most important books such as ''Al-Um'' for Al-Shafi, may Allah have mercy on him, '' Tuhfat Almuhtaj Bishrih Al-minhaj'' for bin Hajar Al-Hitami Al-Maliki, ''Fatah Al-Jawad Bishrih Al-Irshad'' for Al-Hitami, ''Rawd Al-Talib Wa Nihayat Matalab Al-Raghib'' for Ismael Bin Abi Bakir Bin Abdullah Al-Sharji Ibn Al-Maqri Sharaf Al-Din Abo Muhammad, ''Asna Al-Matalib Fe Sharh Rowd Al-Talib'' for sheikh of Islam Zakaria Al-Ansari Al-Saniki Al-Masri Al-Shafi, and the book ''Al-Anwar Li-A'amal Al-Abrar'' is one of the major books in Shafi jurisprudence by the scholar Yousif Al-Ardebili.

My research '' Al-Misbah Al-Munir Wa Al-Murshid Li- Alabir Fi Al-Masir Fima Yata'aq bi Al-Hajj Wa Al-Umrah Fi Al-Muajar Wa Al-Ajir'' for Al-Sharabi who died in (1135 A.

H) (Study and Investigation).

It reveals one of the aspects of Sharia.

In all aspects of life and Islam, Sharia has never overlooked which is an obligation in Quran.

The importance of this research is to achieve several goals that benefit individuals and society.

Also, it is related to economic and eschatological aspects.

The study of the research is in two sections: Sections one: the academic section includes two chapters: a) Chapter one: the author's life (Imam Al-Sharabi) which has two demands: Demand one: his personal life.

Demand two: (Al-Sharabi's scientific life).

b) Chapter two: (the book examining which has four demands): Demand one: (the book name, its attribution, the reason and importance for its authorship).

Demand two: (the author's sources).

Demand three: (my investigating methodology and its general approach).

Demand four: ( describing the handwritten copy and the manuscript samples).

Section two: ( a single written copy was made after verifying the text).
