Companies, as a moral person, have legal personality, when they commit illegal act, a public lawsuit is established against them, which is brought by the Public Prosecution or the civil plaintiff.

Therefore we have devoted this article to the public lawsuit under the criminal law of companies, in order to remove the confusion surrounding corporate cases and the procedures for following up on them, as they are a moral person, as they cannot be present by themselves during the course of the public case.

As a result of our research, we have concluded that the Algerian legislator after the 2004 amendment to the Code of Criminal Procedure, it provided for the application of the same procedures as the conduct of the public lawsuit related to a natural person to companies, which are not sufficient because all the confusion related to make it impossible to apply these procedures to companies.
