تعد الصناعة الدوائية من أهم الصناعات الاستراتيجية وأعقدها، باعتبار أنها تتضمن إنتاج وتسويق سلعة استهلاكية حيوية ذات الارتباط الوثيق بالصحة الإنسانية، وبهدف تأمين الدول النامية-بما فيها الجزائر-لهذه المادة الحيوية لمواطنيها، كان لابد عليها من تشجيع ودعم الاستثمار في الصناعة الدوائية عبر إيجاد آليات قانونية تساهم في توفير المناخ اللازم للنهوض بهذا القطاع الحساس، إلا أن هذا الأمر لا يتأتى إلا عبر تكريس مبدأ الأمن القانوني ضمن هذه الآليات المتاحة قانونا.
وعلى هذا الأساس سنحاول من خلال هذه الدراسة تبيان مدى توافر الأمن القانوني للإبراء الدوائي ضمن الأمر 03 / 07 المتعلق ببراءة الاختراع، نظرا لأهمية ودور البراءة الدوائية في جذب الاستثمار المحلي والأجنبي على حد سواء.
English Abstract
The pharmaceutical industry is one of the most important and complexed strategic industries, which includes the production and marketing of vital consumer related to human health, and in order to ensure developing countries-including Algeria-for this vital product to its citizens, it was necessary to encourage investment in the pharmaceutical industry through the creation of legal mechanisms contribute to provide the necessary climate in order to promote this sensitive sector, however, this comes only by consolidating the principle of legal security within these available mechanisms.
accordingly, we will try through this study, exhaustion the availability of legal security for drug patent within 03 / 07 related to patent, due to the importance and role of pharmaceutical patent in attracting domestic and foreign investment.
