The Algerian Constitutional Council considered as an independent body the constitutional judiciary until the constitutional amendment of 2016, whose formation was considered purely political, which affected its work and His independence, and with the constitutional amendment of 2020, the constitutional founder adopted the Constitutional Court as an independent body from any authority that is considered a qualitative transition in the constitutional judiciary with a formation that somewhat guarantees its independence In Morocco, the constitutional founder adopted the Constitutional Council as an independent body, but it was the same as its predecessor in Algeria with a purely political formation, then the Constitutional Court was adopted with a purely political formation that affects its independence and thus its operation and effectiveness in the rule of law.
