Abstract EN

The short-term imprisonment sentence is a key mechanism to face simple criminality in traditional penal policies.

However, in view of its large negative effects and its inability to deal with simple crime, various modern legislation has sought to include new penal patterns in order to counter simple criminality which would allow rehabilitation of relatively offenders.

In this study, we will shed light on the status of the short-term imprisonment sentence in Morocco's penal policy and the consequences of its use as a formal principal response to the simple criminal phenomenon, and notice that the Moroccan legislator has been aware of its shortcomings and hastened to include in the draft Penal Code N°.
