Abstract EN

The Algerian legislator dedicates an exceptional jurisdiction to the Chamber of commerce at the Algiers Judicial council to consider a large part of the appeals against the decisions of the competition council, although the latter was determined by an independent administrative body, and given the general rules in the distribution of jurisdiction between the administrative judge and the ordinary judge, this jurisdiction belongs to the administrative judiciary.

A superficial look at this exceptional distribution of jurisdiction shows that the chamber of commerce of the Algerian judicial council convenes as an ordinary judge.

However, a deeper study of the transfer of jurisdiction shows that it turns into an administrative judge.
