This study aims to determine the scope of judicial oversight that the Pre-Trial Chamber exercises over the discretionary power of the Prosecutor when he determines that there is a reasonable basis to initiate an investigation on his own initiative, in light of the decision taken by the Appeals Chamber on 05March2020 regarding the situation in Afghanistan, in a first precedent, authorizing an investigation under Article 15 (4) of the Statute at the jurisprudence table of the International Criminal Court, where this historic decision placed the train of supervisory mechanism on correct way practice.
