Most contemporary criminal legislation, including the Algerian legislation, as part of its adoption of the penal mediation system as an alternative to public prosecution, has necessitated the need to obtain the consent and consent of the parties to the public case to resolve the dispute between them through criminal mediation, and the parties 'consent is not limited to their consent to resort to criminal mediation to resolve their dispute.

Rather, it extends to all the stages that the latter goes through, through their participation in the mediation procedures and determining the fate of the public lawsuit, and the aim of that is to embody consensual criminal justice, the essence of which is to activate the role of litigants in the management of the criminal case.
