Extradition is one of the most important aspects of international cooperation between countries, especially in the present time as it became easy for criminals to escape of and move from one country to another with less effort thanks to the development of modern means of transportation and the development of the crimes and methods of perpetrators.

Therefore, the need called for states to cooperate with each other to put in place mechanisms to address the proliferation of criminal organizations and reduce transnational organized crime.

There was also a need to activate the mechanisms of international cooperation and extradition through the conclusion of bilateral or collective international agreements to organize the extradition or trial mechanism following fair and legal procedures and guarantees.

In order to find means to prevent impunity and to legalize the provisions and procedures for the extradition of criminals, many countries have tended to enact special legislation that supports international efforts to combat crime.

Among the most prominent of these legislations was the Federal Law No.

(39) of 2006 regarding international judicial cooperation in criminal matters, which is considered as the most recent Arab legislation dealing with the issue of international cooperation and the procedural mechanism for the extradition system in the United Arab Emirates.

This law focused on the basic rules of the extradition system between the UAE and other countries.

The promulgation of the Law on International Cooperation in Criminal Matters was meant to support the principle of complementarity, which is stipulated in the statute of the International Criminal Court in its preamble as follows: “the most serious crimes of concern to the entire international community must not go unpunished, and it must be ensured that the perpetrators are effectively tried by taking measures at the national level and by strengthening international cooperation.”
