النزعة الذكورية في الفقه الإسلامي : دراسة تحليلية في إطار العلاقة الزوجية

Abstract EN

This study dealt with the doctrinal issues in the context of marital relationship, which has recently been circulated as a consecration of masculine authority over women, whether in the provisions of some of them, or in the presence of phrases addressed by scholars reducing the value of women and degrading their dignity.

The expressions used to accuse Islamic jurisprudence of androcentrism are tracked to reveal the truth, understand the way jurists think, know their point of view when they make judgments, and use some words that suggest a male - centered tendency.

The research came to several results, the most prominent of which is that it is not fair to accuse Islamic jurisprudence of masculinity or bias towards men by means of permissible phrases or partial texts of legitimacy, especially when the jurists’ method of thinking and methodology in examining these issues become evident.

Moreover, custom affects the issuing of provisions and their judgement; and if there is something of this tendency among some of them, it is no more than individual cases that cannot be generalized to all jurists.
