Abstract EN

The subject matter of this research is concerned with the church-related emerging issues (in Islamic jurisprudence) and their impact on highlighting the values of Islamic tolerance.

The research is divided into an introduction and three sections.

The introduction defines and clarifies the terms used in the study, namely: emerging issues, churches, tolerance.

The first section is devoted to the presentation and discussion of one of the fatwas of Ibn al- Haj, which revolves around licensing a group of Andalusian Christians to build churches in Morocco.

As for the second section, it tackles the emerging issue known as «the Jews of Touat», which centres around the sanctity of synagogues and the fact that their demolition is forbidden in Islam, as well as the conflict that occurred between the Islamic jurists Abu Bakr al-Asnuni and Mohammed bin Abdul Karim al-Mughaili regarding this issue.

The third and last section highlights some aspects of Islamic tolerance based on the fatwa of Imam al- Mazri, which provides for the permissibility for non-Muslims to swear oaths in the places that are sacred in their religion such as churches and synagogues.
