Evidence plays a substantial role in the process of proving litigation before the courts, depending on the nature of the proceedings before the judge, since their effect and scope of application is no different in civil and commercial proceedings than administrative proceedings.

Evidence finds its fertile ground when proving the deviation of the administration in the use of its authority while exercising the acts it assumes.

This is because the deviation in the use of power is related to the purposes and intentions of the source of the decision, and it is difficult to prove this intentional nature through other means such as writing and testimony.

Therefore the judge relies on evidence to prove this deviation.
