Abstract EN

This research included an introduction and two topics.

The introduction includes an overview of the content of the study, with a description of the research objectives, its importance and the research problem.

The first topic is entitled “Defining performance orders and distinguishing them from what resembles them.” It is divided into two sub-sections.

The first deals with the performance orders; while the second concerns the distinction between performance orders and similar acts.

The second topic is entitled “The jurisprudential and legislative trends in determining the nature of performance orders.” It is divided into three sub-sections.

The first addresses the view that the performance order is a judicial act.

The second deals with the view that the performance order is considered as an act of loyalty; whereas the third section draws on the opinion that considers the loyalty order as having a dual nature.

The research ended with a set of conclusions and recommendations that are elucidated in the concluding section.
