Abstract EN

There is a set of modern procedures stipulated in the Palestinian Law No.

(4) of 2016 regarding the protection of juveniles, which are followed before the police and the Public Prosecution in the trial of minors who have violated the law.

Among these modern procedures and standards is what is stipulated in Article (15) of Decree-Law No.

(4) of 2016 regarding juvenile protection, on the need to establish a specialized police for juveniles in every governorate.

Also, among the modern procedures that must be followed in the juvenile trial is the allocation of a specialized juvenile prosecution office, and the creation of what is called Child Protection Guide, as was the case in the old Jordanian law named (the watcher of behavior), which came to play an effective role, whether before the Juvenile Prosecution Office or the Juvenile Court.

Other recent procedures before the Public Prosecution, which were also mentioned in the new Palestinian law, include offering mediation, whose positive aspects can affect the juvenile’s behavior and his educational, health and psychological state, as mediation represents a shorthand for many judicial procedures.

Among the other rights stipulated by the New Palestinian law is legal aid through the necessary presence of a lawyer for the juvenile while he is in the prosecution, in addition to the presence of his guardian and child protection guide.

It is to be noted that the legal nature of the concept of juvenile has changed from the previous one, as the juvenile was seen as a defendant under the previous traditional rules.

The new law considers the juvenile as a victim and in need of care to be protected from the danger of delinquency, which is known as the juvenile’s best interest.
