Abstract EN

The FATF, through its revised recommendations, imposed on states the application of the penalty of freezing funds under Security Council resolutions related to the prevention, suppression and financing of terrorism, as well as the spread of armaments.

These resolutions compel countries to freeze the funds or other assets of any person or entity, and to ensure that no funds or other assets are made available, directly or indirectly, to any person or entity, for his or its benefit.

The UAE legislator has mandated specific financial institutions, non-financial businesses and professions, and every natural or legal person to immediately comply with the instructions issued by the relevant authority in the state regarding the implementation of the fund freezing sanction.

This study comes to clarify the concept of the penalty of the freezing of funds in accordance with the relevant Security Council resolutions, and the authority concerned with following up the implementation of this penalty, the obligations imposed by the Emirati legislator, as well as the scope of freezing, the provisions for its cancellation, and the removal of names from the sanctions list.
