Abstract EN

The purpose of this study is to explain the concept of formal defenses and their types in comparison with the provisions of Islamic Shari’a and UAE Civil Procedure Law, in addition to explaining the difference between them and other substantive objections.

The study was conducted in three areas: the first topic dealt with the definition of defenses in general and the statement of its types in Islamic jurisprudence and in secular law.

The second topic concerned formal defenses, their provisions as well as the difference between them and other defenses.

The third topic, however, dealt with formal defenses in the UAE Civil Procedure Law, just as an example, but not limited to: payment of nonspecialization and payment of referral to another court, as well as payment of invalidity, with the rooting of these defenses in Islamic jurisprudence
