The peasant property is considered a pivotal source for achieving food security, and an essential driver for achieving economic and social development.

Therefore, the Algerian legislator took an interest in peasant lands, especially those belonging to private national properties.

The Agricultural Revolution Law, up to Law 87/19 on agricultural investments, however, in light of the ineffectiveness of this legal arsenal in developing the agricultural sector due to granting these properties to non-servants on the one hand, and on the other hand, the lack of effective tribal and dimensional control for the optimal use of this agricultural wealt, This made the legislative apparatus in Algeria move to find alternative forms of its promotion in the agricultural real estate, which was embodied through Law 3/10 related to the conditions and modalities for the exploitation of agricultural lands belonging to the private properties of the state, which adopted the concession as an exclusive pattern for the exploitation of these lands, and the right of permanent use was transferred to A right of concession in light of legal, practical, and technical problems that prevailed in this transformation, in addition to the fact that the problem of agricultural real estate manifests itself in not defining the legal status of the farmer, by defining the legal description of the model farmer, while respecting the peculiarity of the agricultural estate through the existence of a political will to protect his self and its ingredients, and no relationship to how Exploitation, whether it is a temporary use, life, concession or lease, or sale of the problem of agricultural real estate in Algeria.
