Abstract EN

This research aims to explain the tools and criteria adopted for considering the (Maslaha) in Islamic law (shari’a), according to the Islamic jurisprudence (Usul al fiqh), which aims to addresses some emerging facts.

It includes a statement of the status of the (Maslaha) in Islamic law (Fiqh) by stating its position in the imams’ jurisprudence and the ways they dealt with it, then explaining its position in whole Islamic jurisprudence.

Then, it will talk about what are the conditions, and tools used to consider and act on the (Maslaha) Using this as the statments of the former imams and considering the purposes of the Islamic Shariah (Maqasid Al-Shari’a).

In the meantime, it tried to address some of the problems and facts that have arisen in the light of the (Maslaha), and It showed that many interests (Maslaleh) are, in fact, purely corrupting Such as normalization with the usurping Zionist entity.

The research concluded, among other things, that the scholars of Islam agree on the consideration of the (Maslaha) with different ways of expressing it.

Each (Maslaha) took a position against (Islaic shari’a) is rejected.

And the Knowledge of the (Maslaha) only occurs after consultation with specialists in the humanities.
