Abstract EN

This study took up retention custody on Securities in a comparative study with retention custody rules in the Jordanian Civil Procedural Law.

The study aimed to clarify and compare the retention custody on Securities ( Stocks and Bonds) that are for implementing courts requests according to the procedures that are organized in Civil Procedural Law.

And through the study, the researcher find out many results, most important one is that Securities are classified as property rights that putting it under retention is legal, if the legal conditions are available, for all cases, which makes putting debtors property in retention custody includes the Securities.

And the retention custody on the Securities most equal the amount of his debt including fees and expenses, and the retention custody decision issued by courts is considered as a judgment , though it is a temporary procedure.
