The constitutional founder has adopted the system of arguing against the institutionally of law's by Act No 16/01 of 17/03/2016 containing the Constitutional Amendment of 2016.lt is a regulatory and protective mechanism that ensures that fundamental rights and freedoms are protected from all forms of violations of laws.

The introduction of this mechanism has resulted in the regulation of its exercise under legally established conditions and procedures.

It reflected the Constitutional founder’s influence on his French counterpart on how and how the judiciary dealt with institutionality.

In addition, the pattern of balancing the principle of legal security with the order of effects on the ruling of institutionality should be implemented to ensure that retroactivity can only be carried out in accordance with controls which, in their discretion, are subject to the authority of the Constimtional Council in order to protect the acquired rights and legal positions prior to the adoption of the judgment, are unconstitutional.
