Abstract EN

This study was titled: The Fiqh and Legal Approach of Al-Hanbawi in his manuscript Madar Al-Hakam when testifying to rulings.

The study aimed to: To highlight the value of the manuscript, and to serve the Islamic, jurisprudential and legal heritage, as a complement to the efforts of researchers who have the merit of exploring the heritage of Hanafi jurisprudence.

In an attempt intended to raise confusion and ambiguity.

The importance of the study is evident: in identifying an example from of jurisprudential and legal classification, and the extent of the convergence between it and other Islamic schools of jurisprudence, through what it dealt with of legal and legal issues, and its approach to legislative sources.

The problem of the study stems: The problem of the research is summarized in seeing the heritage of this personality and the legal methodology used in one of the sources of the Hanafi jurisprudential abbreviation, and the nature of the study in which it followed the inductive analytical approach.

The study concluded with the most important results, which are: the importance of jurisprudence and law, which shows the greatness of our Islam and its breadth for all, and shows the greatness of our jurists and their deep understanding.

The study recommended that universities and jurisprudence centers pay attention to the jurisprudential and legal curriculum with an effective interest in the lives of Muslims.

And the one who leads the fatwa must pay attention to issues of disagreement without being intransigent to a specific doctrine and refer to evidence because it is signed by the Lord of the Worlds.
