English Abstract

The study investigated the role played by the internal state leg- islations, and regional, international agreements in the situations of mi- grant labor in relation to the countries that export these labors or the importing countries, the negative and positive impacts of these legisla-tion on this migration, and its contribution to support the benefit from human resources.

As the countries of the Red Sea basin were used to be and remaining witnessed a large movement of labor between these coun- tries, especially migration to the Kingdom of Saudi Arabia as one of the oil-rich countries and because it enjoys a strong economy and a broad labor market, the significance of the study lies recently in the fact that, migration has become an inevitable reality in light of The presence of many countries that suffer from a weak economy, besides the existence of legislation that may affect the paths of this migration in terms of reg- ulating the conditions of migrant labors to other countries where there are better job opportunities.

The study aimed to identify the negative and positive effects of the legal provisions that regulate migrant labors.

The study adopted the inductive and analytical method.

The study reached several results and recommendations, the most important results are that there is a great similarity in the rights determined by the internal labor legislation of the countries, at a time when there is a great discrepancy between these legislations, with regard to migrant labor, depending on whether the countries are exporting or receiving these workers, and it is found that countries often resort to concluding bilateral agreements and understandings among themselves in an effort to improve conditions for migrant workers.

While the most important recommendations came to the necessity of preserving the rights of migrant workers and their equality in rights with national workers and seeking to find more understanding and harmony among countries, to set the legal frameworks that contribute to unifying these provisions when migrant workers are not affected nega- tively that may affect their economic, social and health conditions.
