Abstract EN

This research deals with a type of marriage, that is marriage with intention of divorce.

This marriage means: that a man would marry a woman, but he is intending to divorce her after a period of time.

This marriage differs from Marriage of Mott’a but it is consistent with Islamic Shari’a in terms of fulfillment the elements and conditions of marriage, dowry and acquiring all rights.

However, the man did not intend to make a permanent and stabile marriage but a temporary one which should be terminated as soon as he accomplish his aim.

While the Marriage of Mott’a is an agreement between a man an a women, which includes the Mott’a term, and concluded for certain time ranging from a week to a month or more than a month.

The Marriage of Mott’a is invalid marriage according to Sunna doctrine.

The research concludes with that the man who concluded this marriage is obliged by its consequences, such the fate of children and bearing the financial obligations; his wife will heritage him if he died before the termination of contract and the like.
