Abstract EN

The study dealt with arbitration and its impact on settling border disputes, which is considered the first and widely used to resolve political and legal disputes.

the importance of the topic stems from the nature of the problem or issue dealt with by arbitration, and its importance raises the reservation of any country, and deals with two main aspects (border disputes, arbitration as a mechanism for settling disputes), and the importance of borders in the lives of countries due to their close connection with the sovereignty of those countries.

the study aimed to delineate and clarify borders for countries and societies, and shed light on the role of the permanent courts of justice and arbitration in settling border disputes, and to address border disputes and study them from all aspects and to identify the provisions and principles.

the study adopted the descriptive, analytical, inductive and comparative method.

the study reached several results, the most important of which are; states always adhere to the principles of their sovereignty and independence, which makes them believe that giving others the power to compel them contradicts that, and the importance of disputed issues in some cases may push countries not to submit them to international arbitration.

the study came out with several recommendations, the most important of which are ; establishing an Arab international tribunal, accepting international arbitration as the most effective means of resolving border disputes peacefully, activating the role of the permanent court of arbitration in resolving international disputes, and working to revive the project of the arbitration court of justice, which was previously devised and failed due to the conflicting competition of the great powers in the major countries.
