Abstract EN

The study deals with transitional justice under the rule of law.

A case Study for the transitional period for the post-national government of Sudan.

The problem of the study was that the transitional government failure to lay down regulations and laws that clarify the conditions and controls for occupying and practicing political work would impede the course of achieving justice.

Through the problem, the following questions were formulated: what is Transitional Justice based to achieving legitimacy and democracy, which is the most important legitimate practice or legitimate representation? The study assumes that systems and policies have a prominent role in the rule of law and the achievement of justice, the internal and external policies contribute to improving the situation, the absence of good implementation of regulations and laws leads to deterioration and collapse.

The importance of the study stems from highlighting the main and effective role of the rule of law in achieving transitional justice, and its ability to achieve legitimacy, democracy, security and human rights.

The study aimed to describe the relationship between transitional justice and the rule of law, a number of international models of transitional justice have been proposed, a vision for the future of transitional justice in Sudan was formulated.

The study followed the descriptive and historical curriculum.

The study reached several conclusions, including that achieving transitional justice and rule of law depends on the government’s success in implementing laws and regulations, the bad internal and external policies led to the deterioration of the country’s conditions.

The study made several recommendations, including that the rule of law depends on developing and implementing laws and regulations that achieve justice and fairness, the need to reform domestic and foreign policies to improve the country conditions.
