Abstract EN

Groups and elites of Yemeni tribes had prominent roles in various domains of public life in both Morocco and al-Andalus.

this research deals with the elites of the judges of a tribe named Shaaban.

this tribe did not receive a sufficient and appropriate attention in terms of its elites’ role, but there was a confusion or ambiguity that that those elites belong to another Yemeni tribe, which is called al- Ma’afer.

Therefore, the current research aimed to remove this ambiguity and rectify that the elite judges of this tribe descent from their Shabaani origin as well as to highlight the outstanding contribution that they made to the field of judiciary in both Morocco and al-Andalus, despite their minority.

after the introduction, the research dealt with several axes or aspects: it started defining the tribe of Shaaban and its affiliation, and then, it explained the reason why some elites of this tribe were linked to Ma’afer and the origin of such confusion.

this is followed by describing the elites of this tribe, especially judges in both Maghreb and al-Andalus to discover the important contribution they made to the history of the judiciary in those countries.

the research is concluded with a summary of the main findings of the study as well as recommendations.

finally, it presents a list of resources and references.
