Abstract EN

The Geographical Indications Law is one of the laws issued in Yemen on 21/11/2010.

Being the law number (23) of the year 2010, this law governs the trademarks and geographical indications and was issues before Yemen became a member of the WTO.

The law represents one of the requirements for WTO membership and its intellectual property legislations were brought into line with the TRIPS (Agreement on Trade Related Aspects of Intellectual Property Rights).

The law is the first of its kind in Yemen regulating the geographical indications protection though the law in its article (58) indicates the transformation of the rules regulating the geographical indications protections into a resolution to be issued by the Cabinet which has not happened yet.

Due to the great significance of geographical indications in informing customers of the value of a commodity on the basis of its geographical origin, this study is a legal study of the geographical indications in the Yemeni Law.

The study consists of two parts: the first part discusses the notion of geographical indicators, their importance and the conditions necessary to their protection; the second part examines the legal protection of geographical indications with regard to their registration and means of protection assigned to them.
