The malicious lawsuit is considered one of the lawsuits that negatively affect the judiciary.

Therefore, Islamic law, the Palestinian Code of Civil and Commercial Procedure Law, and the Egyptian Civil and Commercial Procedure Law have criminalized it, and the law guarantees everyone the right to litigation, so whoever unlawfully exploits this right is considered an abuser of this right.

In order to limit its spread, the court will rule when it is proven that the lawsuit is malicious, not to accept the case, and the Egyptian pleading law added with it a procedural fine, and if harm is proven, the court will rule for compensation.
