The obligation to inform the insured is considered one of the most important legal appliances directed to restore a sort of balance to the contractual relationship between the insurer and the insured, because information aims to cover the intellectual weakness of the insured with the characteristics of the insurance service.

Therefore, the Algerian legislator has consented to the obligation to inform the insurer, but analyzing the legal texts devoted to him has demonstrated several shortcomings that have limited the effectiveness of his role.

Possibly the most prominent shortcoming in the insurance law is the failure to establish a distinctive obligation to inform the insured.
