This article aims to identify the limits of the use of the right to build that flows from the right to property.

These limits burden the private property in the form work of its social function with diverse urban easements, whether they solely serve the public interest or both of the public and self interest simultaneously.

This article also discloses the legal role entrusted to the administration concerning the issuance of building permits, and the extent of its adherence to the reconstruction easements obligation's, as well as to ensure the implementation of the building permits content's by the landlord or anyone else involved in the construction process.

Furthermore this article seeks to highlight the intervention of the jurisdiction both administrative and ordinary to protect the reconstruction easements that gets violated, as well as to provide juridical protection to aggrieved third parties due
