Abstract EN

The philosophers since the old looked for what justice was and tried to come up with a specific concept for it.

the most prominent of these was Plato and Aristotle، each of them had a vision and own philosophy depending on the circumstances in which he lived.

Plato consider it a virtue and value to the individual and society، while Aristotle was more reliant on reality in building his theory and considered it a realistic value، its essence is mutual equity in the distribution of resources and burdens among members of society.

at the end of the research، the researcher reached to a number of conclusions recommendations، the most important of which are: apply the flexible principles which applicable at any time and place، non-adherence to a particular philosophical approach.

the law will be a flexible instrument applicable within many years and not within specific years، such as the laws of the former of the soviet union which were applied only at the years of commumist rule that didn’t exceed 70 years، while there are legal system (like Islamic law) still applied from thousands years (like the rule : no harm، no harm) because its rules are flexible.
